Well I hate to say it but unless your laws are really effed up he did have the right to take it.
Most cities and towns have bylaws that prohibit firing paintball, airsoft and pellet guns within the limits.
I had a BB gun grabbed ounce and never got it back.

If you want to blaim someone other then yourself blaim the idiots that drive around shooting people on the streets. We have all seen videos or read about this form of twit. Thats why it is illegal now when it may have gone with just a warning 10 years ago.

Yes you should of gave them the talon , they wouldn`t have known any better. I know I would of and your nieghbour is a twit too. Mine let me shoot in the garage but I asked first , might try that next time.
Well good luck on the gun issue but I would be impressed if you get it back..

I remain Phantom-less!  I'm trying to get a hold of the officer who confiscated it, and despite leaving him messages at the station, he doesn't call me back.  Since he works the 7pm-7am shift, hopefully I'll  be able to reach him tonight if I call on every hour.  Then he just has to leave a note with the property clerk and I should get my marker back.

You definitely need to go over his head and be the "squeaky wheel".

What he did was definitely shady and possibly illegal IMHO.

Next time you get on the phone with them, do not hang up until you talk to someone higher up. PERIOD. Ask for the Sergeant or the Chief, which would be best. Speak calmly and explain your situation, and frustration. But like I said, do so calmly and with clear concise sentences. Do not settle for call back tomorrow, go up the chain until you get someone. Even better would be to appear in person and ask for someone higher. If that does not work at all, then go to your Mayor or county/district representative.

For some reason, this neighbor has had it out for us since we moved here.  I don't know if he really liked the people who lived here before us, or if it's something racially motivated (I'm Asian), or what, but he gives us the evil eye everytime we're outside.

And I'm pretty sure he has 911 on speed dial, as if three numbers weren't convenient enough  Grin


i had a neighbor like that he called the cops on my dog because she escaped (she was as harmless as can be) animal control brought her back and said if it happens again shes gonna be put down i was like WTF. the guy lied and said she attacked his dogs (a pit and a rot) he was just a jerk period

Another update: I finally got a chance to talk to the officer (through the grapevine anyway, via the dispatcher) and guess what he says?  It's not up to him to clear the marker for release!  He says I have to talk to the property clerk!

So I've gotten four stories so far: one from the property clerk, who says only the officer can clear it for release; one from the officer, who says it's not up to him to clear it and that I have to speak to the property clerk; one from one of the dispatchers, who says he didn't know it had to be cleared at all to be picked up, and one from another dispatcher, who spoke with his supervisor and said the officer is the only one who can clear it.  Does no one at the police station know proper procedure?!

In any case, I'll be dropping by the police station some time today and explaining everything to the property clerk, so hopefully I'll be able to come home with my much-missed Phantom.

Trust me that they know proper procedure.  They are giving you the runaround and probably hoping that you'll just get frustrated and give up.

Do exactly as Shane-O suggested.  Skip the property clerk and go directly for whoever is in charge.

While on this subject,we all take our property lightly by that I mean serial ## and pics.Take a moment out of the day and take pics and note serial # of your equipment and put an identifying make in stuff that has no ##.
I had a contractor steal a phantom I had in the garage,it was old and had been religated to parts duty but none the less still was a working gun.I didn't miss it till I went looking for it.Thinking I had misplaced or just maybe someone walked off with it.I put the word out locally to all the shops and fields and got a call from a shop.Turned out the guy could not get it to fire more than once after he cocked it.I read him the serial # over the phone (he had me on speaker so he had a witness)He called the police I met them at the shop I brought the pictures of the gun and pics of the serial# on the gun they said great and waited for the guy to show up and arrested him.The theif had a warrent and to this day is still in jail.I got my gun back after he was convicted (about 3 months).I checked with the property clerk weekly and even stopped in on my way to work .I had heard the lost property stories.When released I sighned for it but thats not the end of the story.
I had a conversation with the contractor(owner) about  the theft he said he would make it up to me and asked allot of questions about the marker and set up ect.2 weeks later a brand new phantom showed up.The owner and his kidds now play regularly now to.
So keep on them it will work out !!And get pics of your stuff and note youe serial #!!!!!!!

Well what is the update? If you have not heard anything by now I would go the the Chief of Police or Sheriff whomever it may be and if that fails go to your city manager if it is the city police.

Did you happen to ask him why your property was confiscated if it was not used in the commission of a crime?

That's not going to do a thing. Write a letter to the state attorney general. Ask if this is standard police policy and legal to hold your property in this way. List the run around you've had. Name names of the people at the local cop shop that you have spoken with. Send courtesy copies to your state and district representatives, and the chief of police..........make sure his name is last on the list!

They're playing you like a toy! It time this crap ends.
