Relying on "implications" is bad and the cops probably got you to waive your rights without you even knowing it.  Cops are trained to do that and they are pretty good too.

I imagine that they intimidated you into surrendering the gun because they knew that they had no grounds to confiscate it.  If you'd held your ground (and even directly asked them if they were demanding your property) they probably would've just left you with a warning.

But again I'm no lawyer.

You're probably right.  Under normal circumstances I would have, but unfortunately I still live at home (loser, I know  Cheesy) and my parents forced me into docility.  Which may have proved a good thing, since apparently the crazy neighbor has friends in the local PD, who may very well have dragged me off to the station.

Age prolly had alot to do with it. I mean, if a cop went over to a house for a complaint, and seen a grown man with a marker, instead of some kid (sorry Apoc hehe) things would have turned out different. IMO Grin

But I'm bigger than the cop (topped him by about 5"), and I had a few day's worth of stubble growing!  At 6'2", I'm quite large for a Filipino Wink

Now for the neighbour: you cannot let him get away with this. I would say shoot him in the butt, but there's a chance he might show his bruise to his police-officer-friend again and both might come to the realization that there's not too many suspects around  Wink

So what about this: wait until it's dark, get a nice pile of dog shit, carry it to his frontdoor, cover it up with newspaper, light the paper up, ring the doorbell and . . . run 

Next day you ring again. Look friendly when he opens the door, lean your head to the side and say: "Hey, my Kung Fu is better than yours." Turn around and leave slowly   Afro

Eh, I'm not really one for revenge, so long as I get my marker back.  I'm not beyond flipping him the bird every time I see him, though  >Cheesy

Called the station again, and apparently I have to talk to the officer who confiscated the marker, to see whether or not it was cleared for release.  He gets in after 7, so I'll call back around then.

That's code for "he's still got it in his car/taken it home and has done NOTHING official with it".  I'd work on talking to his sergeant or whoever is in charge.

Normally I'd be inclined to agree with you, but apparently the property claim officer has it in her possession - I just can't go over his head and try and claim it on my own unless I talk to him or the chief of police gives the all clear.  *checks watch*

Update: Couldn't get ahold of the specific PO, but the officer I spoke to said it was unusual that the marker had to wait to be "cleared", and that I can try to pick it up when the property claim officers are in the office around 8 tomorrow.  Hopefully I can snag it since I'm planning on playing walk-ons at 9:30!

I to thought I had an issue when I was outside my shop and a cop car comes pulling in, I thought to myself what the hell did I do now. Well he sat in is car for a few minutes then got out and asked me if I was open as he was holding a tank to get filled.

I thought it was funny cause all my neighbors were looking out their windows thinking I was in trouble.

Now mind you my neighbors dont really care for me. Due to my store cause they thought I was going to "devalue the neighbor hood" with my store. Stupid old people with nothing else better to do!

Hehe, but size has nothing to do with age and wisdom, young grasshopper. Maybe a little intimidating at first, but the cop has the advantage. He has a big gun, even if you had a bigger gun, he has the law on his side.

Nope, not yet.  They're still giving me the runaround.  Basically the property clerk is only there from 10-4, and when I call, she says I have to talk to the officer who confiscated it, and he's on vacation for another two days.  Then I ask if there's anyone else who can make the decision to clear it, i.e. his superior officer, and she says I can speak to the boss - but the boss of the night shift is only there during the night shift, and when I call when the night shift begins, the officers who answer the phones say only the property clerk knows whether it's cleared for release or not o.O

It's all BS, but at least I have my Trracer and my G3 to keep me entertained while my Phantom's in lock-down.
